Terms of Service

1. Service provider

Brújula Creativa is a vocational and professional guidance brand for artists and other creative professionals, administered by Gabriel Villa-Avila. You can contact us at usdclp@gmail.com.

2. Scope of the service

Brújula Creativa offers educational content, an automated mini diagnosis, exploratory interviews, creative-career diagnoses, follow-up sessions, and professional organization tools. The scope, duration, price, and delivery method of each service are shown when you book or purchase it.

The mini diagnosis generates directional hypotheses from your answers. It is not a clinical or psychological assessment and is not a definitive statement about your ability or career.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of accepting these Terms. You agree to provide reasonably accurate information and keep your account secure. You are responsible for activity through your account unless you promptly report unauthorized access.

4. Bookings, prices, and payments

• Prices and currencies are displayed before you confirm a booking or payment.
• Payments may be processed by Stripe, Mercado Pago, or another provider identified at checkout.
• Brújula Creativa does not store complete card numbers.
• Applicable taxes, bank fees, or currency conversions may depend on your location and payment provider.

A booking is confirmed only when you receive confirmation. If a booking link permits scheduling without an online payment, payment arrangements may be coordinated directly before the service is provided.

5. Rescheduling, cancellation, and refunds

Unless the booking page states otherwise, we request at least 24 hours' notice to reschedule. Deposits may be credited toward a diagnosis when the offer says so. A no-show without notice may make the deposit non-refundable.

If Brújula Creativa must cancel, we will offer rescheduling or refund the amount paid for the undelivered service. Other requests will be assessed under the accepted offer, work already performed, and applicable law.

6. Nature of recommendations

Content and diagnoses are educational and provide professional guidance. They are not therapy or medical, legal, tax, accounting, or investment advice. Creative, professional, and financial decisions remain your responsibility.

We do not promise fame, contracts, income, audiences, employment, or specific artistic results. We may present hypotheses, alternatives, and experiments, but no outcome depends on the diagnosis alone.

7. Your participation

The value of the service depends on the quality of the information you provide and your willingness to consider observations that may feel uncomfortable. Purchasing a diagnosis is not purchasing validation. Even so, our observations should address behavior, evidence, and decisions; they are not intended to attack your dignity or identity.

8. Acceptable use

You may use the service for legitimate personal and professional purposes. You may not attempt to compromise the platform, access another person's information, automate abusive requests, impersonate anyone, copy or resell the service as your own, or use it to violate rights or laws.

9. Intellectual property

The Brújula Creativa brand, design, text, methodology, videos, questionnaires, and materials are protected by applicable rights. You retain ownership of the information and creative works you share. You give us only the permission needed to process them and provide the service. We will not publish your music, story, or testimonial for promotion without permission.

10. Third-party services

The service may contain links to or integrations with Google, Supabase, Cal.com, Stripe, Mercado Pago, FormSubmit, YouTube, and social networks. Those services have their own terms and policies. We do not control their availability and are not responsible for conduct attributable solely to those providers, subject to any rights you have under applicable law.

11. Privacy and account deletion

Our Privacy Policy explains how we handle your information. You may request deletion of your account and associated information by emailing usdclp@gmail.com from your account email address.

12. Availability and changes

We may correct, improve, suspend, or modify service features. We will try not to unjustifiably affect a service that has already been paid for. We may also suspend accounts for fraud, abuse, security risk, or a material breach of these Terms.

13. Responsibility

We will provide the service with reasonable care. To the fullest extent permitted by law, Brújula Creativa is not responsible for a user's independent decisions, lost opportunities, campaign or equipment-purchase outcomes, or indirect loss caused by circumstances outside our control. Nothing in these Terms limits non-waivable consumer rights or liability that cannot legally be excluded.

14. Governing law and disagreements

If a disagreement arises, please contact usdclp@gmail.com first so we can seek a good-faith resolution. Applicable law and jurisdiction will depend on who provides and receives payment for the service, your location, and mandatory consumer-protection rules. These Terms do not remove rights granted to you by applicable law.

15. Changes to these Terms

We may update these Terms to reflect service changes or legal requirements. The current version will be published at this address with its update date. Material changes will not apply retroactively to paid services unless required by law or accepted by you.
